This decision affects many people in our classrooms and communities, and we are often unaware of the documentation status of students, staff, and community members and their families. Please see the summary below provided by Dr. Laura Minero. She offers concrete suggestions for supporting all those who are affected by this negative decision as well as a link to resources she has compiled. Please share. It is with a heavy heart that I draw our attention to the recent 5th circuit ruling against the DACA program.

The 5th Circuit has ruled that DACA to be unlawful and sent the government’s new DACA rule back to the trial court to determine whether it suffers from the same “legal defects.” While DACA will continue to temporarily remain in effect for renewals, our community is once again thrown into a state of limbo, waiting to hear the ultimate fate of the program, and our loved ones who have benefited and have also waited to be able to benefit from this program. It is not lost on me that this is occurring during Latinx Heritage month. While it is important to recognize that NOT ALL undocumented folx and DACA recipients are Latinx, it is critical to acknowledge that over 85% of DACA recipients are indeed from Latin America. This is yet again an attach on our community.

For ally’s in our division who are wondering what you can do to support your loved ones, know that your support can truly go a long way. Please contact your representatives and consider the other options I offer in this post to support DACA folx and share with your networks.

WASHINGTON, Oct. 5, 2022—Today, the American Immigration Council responded to the Fifth Circuit Court of Appeals ruling in State of Texas v. USA, in which the Fifth Circuit found the 2012 DACA program to be illegal but sent the government’s new DACA rule back to the trial court to determine whether it suffers from the same legal defects. While DACA will continue to temporarily remain in effect for renewals, the program is on tenuous ground as its legality is again tested before a Texas trial court hostile to immigrants.

The American Immigration Council strongly advocates for Congress to pass a permanent solution for undocumented youth across the United States, including those who participate in the DACA initiative. It has been more than 10 years since the creation of DACA which offered an opportunity for undocumented youth who meet strict criteria to apply for temporary protection from deportation.

“While today’s decision provides a temporary reprieve to thousands of undocumented youth across the country, we should not be fooled. The case is headed back to Judge Hanen’s court in Texas where policies intended to protect immigrants from harsh enforcement have for years gone to die.
