Greetings, Senators and members of the Senate Exec,
Please take a look at this draft Prohibited Discrimination and Retaliation Policy when you have a moment. We will be discussing the policy and other developments in the OICRC in our meeting on April 28. However, please note that Nicole is requesting feedback by 5pm on the 23rd ahead of review by the Policy Advisory Council on May 3. There are steps for additional feedback as part of the policy development process after that date, but if you have suggestions at this point please do bring them forward.

As you may know, the University currently has several different (and not entirely consistent) non-discrimination policies, including the Discrimination Complaint and Response Policy <https://policies.uoregon.edu/vol-5-human-resources/ch-11-human-resources-other/discrimination-complaint-and-response> and the Student Sexual and Gender-Based Harassment and Violence Complaint and Response Policy <https://policies.uoregon.edu/vol-5-human-resources/ch-11-human-resources-other/student-sexual-and-gender-based-harassment-and>. The former requires that all employees report all forms of discrimination and harassment, the latter requires that only those employees who are “designated reporters” report sex and gender based harassment and includes a list of designated reporters. Having multiple policies has resulted in confusion among many concerning their reporting obligations. In addition, both state and federal law have evolved in recent years. For these reasons, over the past few months, a committee of faculty, students, and staff spent a significant amount of time developing a single Prohibited Discrimination and Retaliation Policy.

The Policy includes language required by Oregon’s non-discrimination statutes ORS 350.253 and ORS Chapter 659A, including the Workplace Fairness Act requirements related to the settlement of employee claims, as well as recently enacted changes to Title IX of the 1972 federal Education Act. In drafting the Policy language, we were mindful of distinguishing between policy language, process procedures, and training. We are able to revise practices, procedures, and training materials with relative ease while the policy revision and approval process is much more involved.
