Dear Heidi,
I served as lead psychologist for the U.S. Army’s 101st Airborne Division during wars in Iraq and Afghanistan. I’ve seen a lot while supporting Soldiers in mental health crises, but I’ve never doubted emotional wounds could heal with proper treatments, counseling, and care. Today, I'm a civil rights lawyer working to defend the rights of people with mental illness—including those I served alongside. The Psychiatric Security Review Board is a small government agency—with five unaccountable Board members overseeing adults and another five who oversee youth in their custody. This Board is attempting to change the rules and regulations it must follow to make it easier to lock a person with mental illness away indefinitely—even when they have been symptom-free for many years.

We Must Stop Changes that Harm Our Community
We should all want people with mental health disabilities that have been charged with crimes to get treated, get better, and rejoin society—but the Psychiatric Security Review Board doesn’t live up to that expectation. This Board has proposed regulatory changes:
· Pushing the idea that a person who has a mental illness or other similar condition may be held at the Oregon State Hospital with no possibility of release—even when a person isn’t dangerous because of their condition
· Allowing bureaucrats to judge how a person with mental illness might react to stress at some unknown, later time—and punishing them right now for possible, future behaviors
· Eliminating the need for “criminal intent” when causing harm to another person—even when it’s by accident
Poor Track Record of the Board
Oregon is one of only two states with the outdated model of a Psychiatric Security Review Board that treats the State Hospital as a prison. Currently, it’s refusing to release 42 patients who have been cleared by their treatment teams and no longer need hospital-level care. Over the course of one-year, these 42 people will cost Oregon taxpayers more than $20 million. Meanwhile, these 42 people are being robbed of their rights and lives—some for years. I am sure their number will grow if these rules are adopted as proposed.

We all know there are people who need to be at the Oregon State Hospital but cannot get in. When the hospital is full of people who don't need to be there, there is no room for people who need its treatment most.

We will be testifying and submitting a written comment opposing the proposed rules changes. But we also need your help—here is what you can do:
