Subject: buyers: New federal regulations - Uniform Guidance - effective July 1, 2018

Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, known as the "Uniform Guidance", is a new set of federal regulations governing use of federal funds.  These new regulations are effective for UO July 1, 2018.

On the whole, procurement requirements for purchases made with any federal funds will not change, except as follows:


  *   Departments will be required to collect and submit 3 quotes for purchases between 10k and 25k, unless those purchases are made via Duck Depot.
  *   When conducting RFPs, APs, or a sole source purchases valued over $10,000, UO will develop a cost and price analysis as part of award review.
  *   Exemptions from competition will be granted only under the following circumstances:
     *   The federal agency has expressly waived a competitive procurement requirement
     *   The goods or services to be purchased are from a true sole source
     *   There is an emergency giving rise to the need for the purchase
     *   UO has conducted a procurement and only received one, or no responses
  *   For each purchase over 10k made with federal funds, the department will record (1) rationale for the method of procurement; (2) rationale for the type of contract used; (3) basis for contractor selection or rejection; and (4) basis for the contract price for each transaction funded by a federal grant.
  *   The PCS portal will be set up to prompt departments to provide any additional information and/or record justifications.

Two trainings regarding Uniform Guidance will be offered this month and additional trainings will be offered through August.
